Specifically, it has been claimed that JNJ failed to disclose and misrepresented the following: (1) starting in April of 2008, JNJ received numerous consumer complaints that Tylenol products made at a manufacturing facility in Las Piedras, Puerto Rico exhibited a "musty" odor; (2) that despite being aware of these complaints, JNJ and certain officers and directors failed to conduct an adequate investigation and failed to notify the U.S. Food and Drug Administration ("FDA") as required; and (3) that defendants failed to take corrective action when foreign materials and contamination were found in a manufacturing facility in Fort Washington, Pennsylvania from May 2009 to April 2010. Moreover, it has been alleged that JNJ and certain officers and directors failed to disclose that they have been forced to issue over eight separate recalls including dozens of products and hundreds of millions of individual packages. Defendants are now under investigation by the U.S. House of Representatives, the U.S. Senate, and the U.S. Attorney's Office for the Eastern District of Pennsylvania, and multiple state Attorneys General offices.
