THCA is non-psychoactive in its raw form, but decarboxylates into Delta-9 THC when heated, such as through smoking or vaping. Industry experts argue that measuring total THC, including THCA, provides a misleading indication of a product's actual intoxicating potential.
This approach differs significantly from most other states with legal hemp programs, many of which adhere to the federal 0.3% Delta-9 THC standard. The discrepancy creates confusion for both consumers and businesses operating across state lines. Moreover, the 0.5% limit, even when calculated using the total THC method, effectively eliminates many popular and legally compliant hemp products from the Texas market.
