NEW YORK--([ BUSINESS WIRE ])--Bernstein Liebhard LLP has commenced an investigation into possible breaches of fiduciary duty and other violations of the law by certain officers and directors of Gentiva Health Services, Inc. (aGentivaa or the aCompanya) (NASDAQ: GTIV). The investigation concerns whether Gentiva unfairly took advantage of the Medicare reimbursement system by increasing the number of in-home therapy visits, some of which were allegedly not medically necessary.

In this regard, on May 14, 2010, Gentiva announced that the Senate Finance Committee sent the Company a letter requesting that it provide various data related to the utilization of services. Approximately two months later, on July 13, 2010, the Company announced that the U.S. Securities and Exchange Commission asked Gentiva to preserve all documents related to Medicare reimbursement practices and was further advised that a subpoena would be forthcoming in the next few days.
