Judge finds 'Utah Fits All' scholarship unconstitutional, legislature to review options

Utah's Third District Court has found the 'Utah Fits All' scholarship program to be unconstitutional, in a ruling that was by the court earlier today.

A Utah judge has ruled that the state's Carson Smith Special Needs Scholarship program, which provides funding for students with disabilities to attend private schools, is constitutional. The decision came after a lawsuit claimed the program violated the state's constitution by using public funds for religious education. Judge Keith Kelly dismissed the lawsuit, stating that the program does not favor religious schools and that parents have the choice of where to use the scholarship funds. The ruling allows the program to continue, providing financial assistance to families of students with disabilities to access specialized education that meets their needs.
